Calhoun v. Rocky Mountain Wholesale - Alameda County (Oakland) - 2003
Brian H. Buddell represented Rocky Mountain Wholesale ("RMW") in a two-car collision on Fruitvale Avenue in Oakland, California.
Plaintiff, a passenger in a truck operated by RMW was injured when the co-defendant made a left turn in front of the truck.
Plaintiff further alleged that the driver of the RMW vehicle was traveling far in excess of the posted speed limit-which was corroborated by physical evidence from the scene-and claimed over $100,000 in damages as to each of the two defendants.
Prior to the commencement of trial, RMW made a settlement offer of $35,000 which was rejected by plaintiff.
After a six-day trial, the jury awarded $24,000 as to RMW and $76,000 against the co-defendant.
