In 2001 John Brydon obtained voluntary dismissals for three major corporate clients in two cases involving plaintiffs with lung cancer.
Brydon represented Certainteed Corporation, U.S. Gypsum and a subsidiary of Federal Mogul (Turner & Newell) who had manufactured asbestos containing products allegedly used by two plaintiffs in the course of their work in refineries.
After nearly a month of trial and at the end of plaintiff's case in chief, plaintiff's counsel dismissed all of Brydon's clients in exchange for an agreement that he not further participate in trial or assist the remaining refinery defendant, which was found liable for a 12.5% share of a $4.3 million verdict in one of the cases.
