Plaintiff claimed that he had observed the defendant insulation contractor at many of his job sites and that the dust created during installation caused his mesothelioma.
Defense counsel Edward Hugo disputed plaintiff's claim that the defendant was present at the specific worksites at issue during the trial and argued that statistically it was more likely that the defendant had contracted his disease from a primary site, rather than from activities linked to the defendant.
The plaintiff had been demanding $2 million.
The jury found for the defense.
