Facts and Allegations:

Plaintiff's filed a wrongful death complaint on March 22, 2006, alleging that decendent, Gary Short, died of mesothelioma as a result of his occupational exposure to asbestos In the Navy (1957-1961) and while employed by PG&E (Pacific Gas & Electric) as an oiler/operator (1961-1966). Foster Wheeler denied Plaintiff's allegations and was dismissed by Plaintiff's after the conclusion of their opening statement.
