Edward Hugo and Gregory Rosse successfully defended their client, Foster Wheeler, LLC in a personal injury action (lung cancer and asbestosis) brought by Waters & Kraus in the Los Angeles Superior Court. Plaintiffs claimed that Bobbie Cummings contracted lung cancer and asbestosis while working with and around Foster Wheeler boilers as a boiler tender in the United States Navy from 1956 through 1976. After the close of plaintiffs’ case, Foster Wheeler’s Motion for Non-Suit was granted as to all intentional tort causes of action, punitive damages and economic damages. Thereafter, the case was settled for 1/20th of the original demand.
