When on the eve of jury selection, the trial judge decided to consolidate for trial a wrongful death mesothelioma suit with a living kidney cancer case, the lawyers at Brydon Hugo & Parker filed an emergency petition for a writ of mandate.
The First District Court of Appeal promptly stayed the consolidation order and ordered briefing.
Two weeks later the First District vacated the consolidation and plaintiffs' counsel dismissed BHP's client from the personal injury trial.
